Pfizer did not appeal that decision, and the U. S. Food and Drug Administration (FDA) issued a warning letter on April 10, 2018, advising users and healthcare professionals to stop using Viagra and warning that its use could lead to erectile dysfunction or other sexual-related issues.
Pfizer’s patent for the drug contains the key ingredient, sildenafil, which Pfizer was granted exclusive rights to manufacture and market the drug in the United States, under thePatent Act.
Sildenafil is the active ingredient in Viagra and Pfizer’s patent on the drug expired in November 2017, so that sildenafil cannot be sold on the market without the supervision of a licensed healthcare professional. However, if a new drug is developed with sildenafil, it will be available on the market without patent protection in the United States.
In December 2017, the U. Food and Drug Administration (FDA) approved a drug calledSildenafil (Viagra) Connect, an oral tabletand a treatment for erectile dysfunction (ED).
